While the debate over legalizing drugs continues in some jurisdictions, the attorneys at Davis and Stephenson, P.L., firmly believe that the government should never criminalize first-time drug use/abuse, but rather treat it as a medical issue through drug counseling and treatment. The Florida Legislature has enacted certain statutes that allow dismissal of first-time drug offenses through treatment, even over the objection of the prosecutor. In Florida, it's unfortunate that this is not yet automatic (the Judge may still deny such disposition), but it is a possibility that an unfortunate number of criminal defendants never learn about because his or her attorney may not know or understand the availability of the program.

If a Judge denies treatment and eventual dismissal of the charge, there are other options that may be available, some of which may eventually allow the dismissal or sealing of your case. It is absolutely imperative that a first-time offender seek an experienced attorney who knows about all possible diversion programs available.

If you are charged with a first-time drug offense, or any first-time offense, this is a critical juncture in your life. You need to seek every alternative avenue other than a conviction. Stepping into the realm of the a convicted defendant could have severe repercussions on your job, your family, your education, your housing, and so on.

With all the diversion programs available, it is also important to realize that the same defenses and constitutional rights apply to first-time offenders. The diversion programs are not a substitute for a motion to dismiss, but rather an option if no motion or trial issue rises from the facts.
